Muscat municipality : a decision to organise installation of sun shades in front of residential buildings
His Excellency Mohsin Al Sheikh Chairman of Muscat municipality issued a ministerial decision no. (95/ 2018) regulating installation of vehicle sun shades in front of residential buildings outside the boundaries of a land plot.
The decision cancels all that contravenes the regulations annexed and was based on Muscat municipality law issued by the royal decree (38/2015), and the local Order No. (23/ 92) on the organization of buildings in Muscat govenorate.
Technical controls
Article (2) of the regulation stipulates that it is not permissible to establish a sun shade in front of residential buildings and outside the boundaries of the land plot before obtaining a license (a written approval issued by the municipality). Article (3) emphasises that the land is designated for a residential use only, and the minimum distance between the outer wall of the building and the street is (4,5 m), if it was less, the area of the sun shade should parallel the street.
Each residential building should not install more than (4) sun shades, or equivalent to (50%) fifty percent of the length of the outer wall of the building, whichever is less.
Requirements
(4) stipulates that the sun shades are only installed in front of the residential building according to designs and models of the municipality, and only after (2) two meters from the outer wall of the building.
It may by an exception to reduce that distance to (5,1 m) in the cases decided by the municipality, allocating that distance for a corridor aligning the building and without any obstacles including planting trees.
One of the contributions is to leave a distance of not less than (0,5 m) of half a meter between the sun shade and the street. All excavation work shall be only made manually, using a canvas (polyethylene) high density, or similar, with a color specified by the municipality. .. The columns are painted by colors designated by the municipality, and that the installation of the floor tiles according to the specifications specified by the municipality, with the license number of the municipality installed according to the selected model.
Article (5) of the regulation stipulates that "the license is not a reason to won the property, or any concrete item in the site. The decision prohibits installation of sun shades at a dual carriageway that are less than 30 meters, and to pay a fee of 60 rials for each car park for one time, and obliges the owner to maintain the sun shade periodically.
The decision says hat anyone who contravenes these regulations is penalised by a fine of (100) rials, with obliging the offender to correct the violation, if it is not to corrected within a time limit, the municipality shall impose a fine of (10) ten Omani rials for each day of delay, with a maximum amount of 100 Omani rials.
